The exemption of hunting is revised to include fishing and any other activity regulated by the wildlife code. The exemption of rodeo practices is revised to repeal the requirement that the rodeo practices be sanctioned by the Professional Rodeo Cowboys Association. Instead any professional or amateur rodeo practice or skill event is exempted when it is not intended for use in violation of Proposition A. The bill has an emergency clause. HB 79 ANIMAL FIGHTING (Ransdall) This bill modifies Proposition A as approved by voters on November 3, 1998, relating to animal fighting. Activities exempted from the provisions of Proposition A are expanded to include fishing regulated by the Missouri Department of Conservation. The exemption of rodeo practices sanctioned by the Professional Rodeo Cowboy's Association is changed to rodeo practices approved by the state Department of Agriculture. FISCAL NOTE: No impact on state funds.

"I am pleased to join my fellow veterinarian, Senator Wayne Allard, along with Senator Maria Cantwell in introducing this bill, Ensign stated. This legislation targets the troubling, widespread and sometimes underground activities of dogfighting and cockfighting where dogs and birds are bred and trained to fight to the death." Ensign continued, "Just recently in Las Vegas, a pit bull named Petunia was recovering from extensive injuries after she was used as bait in an illegal dogfighting ring. These activities are reprehensible and despicable. I am committed to doing all I can to ensure the end of illegal animal fighting. We cannot allow this barbaric practice to continue in our civilized society." After more than a three year battle, we were able to bring parity and greater leverage to enforce state laws banning cockfighting," said Allard, a licensed veterinarian. "Now we need to give law enforcement officers the teeth to enforce these laws."

(b) Buying, selling, delivering, or transporting animals for participation in animal fighting venture It shall be unlawful for any person to knowingly sell, buy, transport, or deliver to another person or receive from another person for purposes of transportation, in interstate or foreign commerce, any dog or other animal for purposes of having the dog or other animal participate in an animal fighting venture. (c) Use of Postal Service or other interstate instrumentality for promoting or furthering animal fighting venture It shall be unlawful for any person to knowingly use the mail service of the United States Postal Service or any interstate instrumentality for purposes of promoting or in any other manner furthering an animal fighting venture except as performed outside the limits of the States of the United States. (d) Violation of State law Notwithstanding the provisions of subsections (a), (b), or (c) of this section, the activities prohibited by such subsections shall be unlawful with respect to fighting ventures involving live birds only if the fight is to take place in a State where it would be in violation of the laws thereof.
