Boating Safety Course The Nautical Know How Basic Boating Course is a NASBLA approved course. Successful completion of this course meets Virginia's requirement for boating safety education. This section contains information on Virginia Boating Regulations that are in addition to the Federal Requirements covered in the Basic Boating Course . If you have not reviewed the course material, please do so now. All Federal Requirements in the basic boating course apply to Virginia; this section lists Virginia Boating Requirements that are above and beyond Federal Requirements. Age Restrictions: PWC operators must be at least fourteen years old. Effective 01/01/99, PWC operators between the age of 14 and 16 must have proof of successful completion of an approved Boating Safety Course in order to operate a PWC. Successful completion of this Basic Boating Course meets Virginia's boater education requirements.
Personal Flotation Devices: There must be at least one wearable life jacket (PFD) for each person onboard. The PFD must be Coast Guard approved, in good and serviceable condition and of the proper size for the person. In addition, boats 16 feet and greater must also carry a throwable flotation device (ring buoy or seat cushion) Coast Guard approved and in good and serviceable condition. All personal watercraft (PWC) operators and passengers must wear an approved Type I, II, III or V PFD.

Scholarship § 127-2-6 Scholarship A student is required to do passing work in the equivalent of at least 20 periods (four subjects with full credit toward graduation) per week. Failure to earn passing marks in four full credit subjects during a semester shall render a student ineligible for the following semester. A semester course that constitutes 8100 minutes of instruction (block schedule) will count as two subjects. The student may select four full credits from any area of the curriculum offered by the school. If a student is taking a multiple period subject, such as block or vocational courses for a full morning or afternoon, it may be counted as more than one subject. The number of subjects counted will be equal to the units of full credits given. If a student has been declared ineligible according to the standards outlined above, the student may attend summer school and have eligibility reinstated if the student meets the standards at the conclusion of summer school. If a student has been declared ineligible according to the standards outlined above, the student may have eligibility reinstated at midsemester if the student is meeting the standards at that time.

Coaches § 127-3-6 Coaches A member of a school faculty, substitute teacher or student teacher, with or without West Virginia Department of Education Authorized Certification, within a public, private, or parochial school system shall be allowed to coach an athletic team. Also, an authorized certified individual may coach if he meets all of the requirements in 6.5 of this rule. A member of a faculty shall be considered one who is a full-time teacher as defined by the West Virginia Department of Education. A member of a faculty in one school may coach in another school provided that it meets with the approval of the said county board of education or two different county boards of education. A substitute teacher is defined as a person who has met the licensure requirements as specified by the West Virginia Board of Education and has been approved as a substitute teacher of that county board of education, private, or parochial school. An authorized certified coach must meet the following requirements: The coach is employed under a contract with a county board of education which specifies a rate of pay equivalent to the rate for professional educators who accept similar duties as extra duty assignments and which provided for liability insurance associated with the activity.

Dear Mr. Larsen:
The West Virginia Department of Education is in receipt of correspondence from you requesting interpretations of numerous applications of school law. In the responses, I have cited several provisions of a version of West Virginia Board of Education Policy 4110 , Attendance, which has been placed on public comment by the Board until May 21, 2002. Although the Policy has not been formally adopted by the Board, it is my hope that the Policy will be adopted in its entirety at the end of the public comment period. In a letter dated August 16, 2000, you requested legal interpretations for the following issues:
1. Can a school prohibit a student from making up academic work for credit which he/she misses during the tenure of a given suspension? Pursuant to West Virginia Board of Education Policy 4110 , Attendance, section 6.1.3(b), a county is required to develop procedures and reasonable time lines requiring students with excused absences to make up school work. Unexcused absences are not addressed.

Attorney Referral Program The WVEA/NEA Attorney Referral Program is a result of the group purchasing power of the over 2 million NEA members throughout the country. It provides you with free consultation (up to 30 minutes twice a year) with one of the Referral Program attorneys, and for considerably reduced rates for legal services you might need. Who is eligible? All active, life, education support or retired NEA members and, at the request of the member, his or her spouse and dependent children. What are the services? Each eligible member is entitled to two free consultation sessions of up to 30 minutes each on any legal topic affecting an eligible participant (except income tax preparation) during each program year. PRESENTED BY VENDORS OF PRODUCTS AND SERVICES

The MCLE Board has observed an increasing trend in the number of courses and programs submitted for accreditation by program sponsors who sell or provide certain products or services. Such courses and programs (hereinafter referred to as "Vendor Programs") will be subject to close scrutiny by the Board to insure that the primary objective of the Vendor Program is to increase the attendees' professional competence and skills as an attorney and to improve the quality of legal services rendered to the public, as opposed to selling a product or service. Vendor Programs addressing the use of hardware, software, other equipment and tools, or procedures that are specific products or services of a particular company or person will not be accredited unless such Vendor Programs otherwise meet the requirements of the Rules of Court, the Mandatory Continuing Legal Education Regulations, and the Opinions of this Board.
