Ordinances and Waterway Markers
Boating Ordinances Before boating on an unfamiliar Wisconsin waterways check for a sign at the public boat landing to determine if there are local regulations (more restrictive than state law) which may apply on that waterbody. Wisconsin law allows local municipalities to enact local regulations relative to boating in the interest of public health, safety or welfare, including the public's interest in preserving the state's natural resources. Local municipalities may have regulations governing such things as water skiing, shore zones, speed limits, etc. State boating law provides a general framework of regulation, but it is up to local municipalities to provide regulations tailored to local conditions. The authority to enact local regulations is found in Chapter 30.77 of the Wisconsin Statutes. If your municipalities would like assistance or advice in drafting local regulations contact your regional law enforcement safety specialist at your regional DNR headquarters. Waterway Markers Once a boat speed limit or controlled area has been lawfully established, regulatory signs or buoys may be posted by the local government pursuant to a permit issued by the Department of Natural Resources. The Department grants permits to governmental entities pursuant to Section 30.74(2), Wis. Stats., and Chapter NR 5.09, Wis. Adm. Code, which specifies buoy standards and permit requirements. Local municipalities may also receive a permit to place aids to navigation such as channel buoys or hazard markers.

New Boating Safety Regulations Expected to Save Lives
January 18, 1999 TORONTO - David Anderson, Minister of Fisheries and Oceans, today unveiled changes to the regulatory framework governing recreational boating safety in Canada. The changes are designed to reduce the annual level of boating fatalities and accidents in Canada from their current levels of 200 and 6,000 respectively. "These are not "made-in-Ottawa" solutions," said Minister Anderson. Describing the extensive consultations that gave rise to the regulations, Minister Anderson stated, "They result from an extensive process of dialogue with Canadians who share an interest in making our waters safer. These individuals are the real architects of these common-sense and balanced measures." The new measures were presented to some 60 boating association representatives from across Canada at the Toronto International Boat Show. Highlights of the changes include the introduction of:

SIGN UP NOW! Radio Regulations Carrying a Radio Most recreational vessels under 65.6ft/20m in length do not have to carry a marine radio. Any vessel that carries a marine radio must follow the rules of the Federal Communications Commission (FCC). Radio Licenses The FCC does not require operators of recreational vessels to carry a radio or to have an individual license to operate VHF marine radios (with or without digital selective calling capability), EPIRBs, or any type of radar. Operators must however follow the procedures and courtesies that are required of licensed operators specified in FCC Rules. You may use the name or registration number of your vessel to identify your ship station. Users of VHF marine radio equipped with digital selective calling will need to obtain a maritime mobile service identity (MMSD number from the FCC. It is unlawful to use digital selective calling without obtaining this identity.

Pollution Regulations Tire Refuse Act of 1899 prohibits throwing, discharging or depositing any refuse matter of any kind (including trash, garbage, oil, and other liquid pollutants into the waters of the United States. The Federal Water Pollution Control Act prohibits the discharge of oil or hazardous substances which may be harmful into U.S. navigable waters. Vessels 26 feet in length and over must display a placard at least 5 by 8 inches, made of durable material, fixed in a conspicuous place in the machinery spaces, or at the bilge pump control station, stating the following: Discharge of Oil Prohibited The Federal Water Pollution Control Act prohibits the discharge of on or oily waste upon or into any navigable waters of the U.S. The prohibition includes any discharge which causes a film at discoloration of the surface of the water or causes a sewage or emulsion beneath the surface of the water. Violators are subject to substantial civil and/or criminal sanctions including fines and imprisonment.

Age-horsepower Restrictions*
Power restrictions as of April 1, 1999
- Under 12 years of age, and not directly supervised** can operate a vessel with no more than 10 hp (7.5 KW)
- Between 12 years and under 16 years of age, and not directly supervised** can operate a vessel with no more than 40 hp (30 KW)
- 16 years of age and over have no power restrictions
* These requirements apply in areas outside the Northwest and Nunavut Territories at this time.
** Directly supervised means: accompanied and directly supervised by a person 16 years of age or older.
Age-horsepower restrictions come into effect on April 1, 1999. These restrictions prohibit operators under the age of 16 year from operating craft above specified horsepower limits. This applies to the operation of pleasure craft fitted with a motor and used for recreational purposes. If an operator is accompanied and directly supervised in the pleasure craft by a person 16 years and older, the age-horsepower restrictions do not apply. These restrictions also prohibit persons under 16 years from operating personal watercraft regardless of whether they are accompanied by an adult.
The following table summarizes how these restrictions apply.

1) one Canadian-approved personal flotation device or lifejacket of appropriate size for each person on board
2) one buoyant heaving line of not less than 15 m in length
DISTRESS EQUIPMENT
3) a watertight flashlight OR 3 Canadian approved flares of Type A, B or C
NAVIGATION EQUIPMENT
4) a sound-signalling device or a sound-signalling appliance
5) navigation lights that meet the applicable standards set out in the Collision Regulations if the pleasure craft is operated after
sunset and before sunrise or in periods of restricted visibility. The Canadian Coast Guard and PWC manufactures
strongly advise against operating at night BOAT SAFETY EQUIPMENT 6) one manual propelling device OR an anchor with not less than 15 m of cable, rope or chain in any combination 7) one bailer or one manual water pump fitted with or accompanied by sufficient hose to enable a person using the pump to pump water from the bilge of the vessel over the side of the vessel 8) one Class 5BC fire extinguisher. This equipment is not mandatory if all people on the PWC are wearing Canadian-approved personal flotation device of appropriate size.
