What Is Child Care?
The law defines child care as:
  • three or more unrelated children under 13 years of age
  • receiving care from a non-relative
  • on a regular basis, of at least once a week
  • for more than four hours per day but less than 24 hours.
When all of these conditions exist, regulation is required. The North Carolina Division of Child Development, in the Department of Health and Human Services, is responsible for regulating child care. The purpose of regulation is to protect the well-being of children while they are away from their parents. The law defining child care is in the North Carolina General Statutes, Article 7, Chapter 110. The North Carolina Child Care Commission is responsible for adopting rules to carry out the law. Some counties and cities in North Carolina also have local zoning requirements for child care programs. Family child care homes and child care centers must be licensed. Once a license is issued, it does not have to be renewed. Licenses will soon have a rating that will reflect the program's standards, staff education, and compliance with the law. There are different requirements for licensed family child care homes and child care centers based on the number of children in care.

Who is responsible for training providers about HIPAA?
Although provider education will be sponsored for North Carolina’s Medicaid providers, providers must understand that education will be limited to general HIPAA information and its outcome and effects as it relates to the N.C. Medicaid program only.  Training and information offered by the N.C. Medicaid program does not relieve providers from the responsibility of educating their staff on HIPAA regulations regarding transaction and code set standards, privacy regulations, and security regulations.  Providers are encouraged to review the HIPAA rules and discuss required changes with their billing departments, billing agents, and clearinghouses.

    The General Assembly of North Carolina combined 16 institutions into a single University of North Carolina governed by a Board of Governors and administered by a president, who has complete authority to manage the affairs and execute the policies of the University of North Carolina and its constituent institutions, subject to the direction of the Board of Governors and the provisions of The Code .     As of late last year, the State of North Carolina had 20,313 rules in place, with the number growing each year. At least as measured by the number of pages of new rules published in the North Carolina Register , the amount of state regulation had been increasing at an alarming rate. From 1987 to 1994, the total number of pages of new regulations roughly doubled. Furthermore, the number of full-time positions at state regulatory agencies has grown by 60 percent over the past two decades.
    53 cents of every dollar earned was spent on government programs directly or indirectly.
    Of course, the costs of regulation represent only one side of the ledger. Perhaps these costs are justified if the benefits, similarly quantified, exceed them. But available evidence would suggest otherwise. Environmental regulations in particular often cost far more than their benefits would justify. A recent Harvard study concluded that Americans incur opportunity costs of approximately $31.1 billion, 60,200 premature deaths, or 636,000 years of life lost every year in order to maintain our current inefficient pattern of regulation and risk reduction.
    In 1995, the General Assembly adopted a regulatory reform measure to give the state's Rules Review Commission increased oversight in the rulemaking process. While many critics have viewed this as an unwarranted and perhaps even unconstitutional one, it represents a valuable first step in regulatory reform. What policymakers need to do now is refine and expand this process as follows:

    • We are here today to talk about Ed-Flex- a common-sense program in which all states should be able to participate. We will hear from GAO, who will report on how Ed-Flex has been implemented in the states. In addition, we will also hear from Texas and Ohio about their experiences with Ed-Flex, as well as the state superintendent from North Carolina and a local school superintendent from Maryland. On Tuesday, Mr. Roemer and I introduced H.R.800, the Education Flexibility Partnership Act of 1999. Our bill would lift the 12 state cap off this program and allow all 50 states to apply. It also adds more accountability language to ensure that states measure the performance of students affected by the program. States and local school districts have been telling us for some time now that they need more flexibility. Right now there are scores of K-12 federal education programs, which require thousands of administrators in state education agencies across the country. Paperwork requirements and regulations often put state and local school districts in the position of having to put compliance before performance.

    UNCW had a modest beginning in 1947, when the first class of 186 freshman at Wilmington College shared classroom space with New Hanover High School students. Since then, UNCW has grown tremendously both in size and reputation. With the passage of the $3.1 billion N.C. Higher Education Facilities Bond issue in November 2000, UNCW will see the largest construction effort in its history over the next six years. With its $108 million, UNCW will build three new buildings and renovate eight existing structures. Construction is underway for a classroom building and resource center for the Watson School of Education and a 263-bed student residence hall that will showcase a new initiative whereby residents will be members of a learning community. Plans are being developed to expand and renovate the current University Union and the Burney Student Support Center to include a new 62,776-square-foot building, which will provide expanded food services, a cafe, a movie theatre, a copy center, banking services and a convenience store. This construction is being financed through student fees. An arboretum campus situated on a 661-acre tract bordering South College Road, UNCW is a fully accredited, comprehensive level 1 university in the state's 16-campus University of North Carolina system. Through its College of Arts and Sciences, the professional schools and the graduate school, the university seeks to stimulate intellectual curiosity, imagination, rational thinking and thoughtful expression in a broad range of disciplines and professional fields. Of prime importance is the university's commitment to undergraduate teaching. The humanities, the arts, the natural and mathematical sciences, and the behavioral and social sciences make up the core of the undergraduate curriculum. Strong graduate programs complement the undergraduate curriculum.
