    In each and every statute of this state heretofore enacted, and now in effect, in which the phrase "kindred within the third degree" or "relationship within the third degree" is used, and in which no other rule is applied or indicated, the civil law rule in computing relationship shall govern.

    SEC. 1-3-73. Civil law to apply in construing.
    The civil law rule of computing kinship or relationship is hereby adopted and shall hereafter control in this state where the computation of relationship or kinship, either by blood or marriage, is brought in question in construing any legislative enactment or statutory law in the State of Mississippi.

    • (a) Authentication.
      (a) Authentication.
        (1) Domestic. An official record kept within the United States or any state, district, commonwealth, territory, or insular possession thereof, or within the Panama Canal Zone, the Trust Territory of the Pacific Islands, or the Ryukyu Islands, or an entry therein, when admissible for any purpose, may be evidenced by an official publication thereof or by a copy attested by a person purporting to be the officer having the legal custody of the record, or his deputy. If the official record is kept outside the State of Mississippi, the copy shall be accompanied by a certificate under oath of such person that he is the legal custodian of such record and that the record is kept pursuant to state law.
      (b) Lack of Record. A written statement that after diligent search no record or entry of a specified tenor is found to exist in the records designated by the statement, authenticated as provided in subdivision (a)(1) of this rule in the case of a domestic record, or complying with the requirements of subdivision (a)(2) of this rule for a summary in the case of a foreign record, is admissible as evidence that the records contain no such record or entry. (c) This rule does not prevent the proof of official records or of entry or lack of entry therein by any other method authorized by law.

    The Civil Rights of Freedmen in Mississippi Section 1. Be it enacted by the legislature of the State of Mississippi, That all freedmen, free Negroes, and mulattoes may sue and be sued, implead and be impleaded in all the courts of law and equity of this state, and may acquire personal property and choses in action, by descent or purchase, any may dispose of the same, in the same manner, and to the same extent that white persons may: Provided that the provisions of this section shall not be so construed as to allow any freedman, free Negro, or mulatto to rent or lease any lands or tenements, except in incorporated town or cities in which places the corporate authorities shall control the same. Sec. 2. Be it further enacted, That all freedmen, free Negroes, and mulattoes may intermarry with each other, in the same manner and under the same regulations that are provided by law for white persons: Provided, that the clerk of probate shall keep separate records of the same. Sec. 3. Be it further enacted, That all freedmen, free Negroes, and mulattoes, who do now and have heretofore lived and cohabited together as husband and wife shall be taken and held in law as legally married, and the issue shall be taken and held as legitimate for all purposes. That it shall not be lawful for any freedman, free Negro, or mulatto to intermarry with any white person; nor for any white person to intermarry with any freedman, free Negro, or mulatto; any person who shall so intermarry shall be deemed guilty of felony and, on conviction thereof, shall be confined in the state penitentiary for life; and those shall be deemed freedmen, free Negroes, and mulattoes who are of pure Negro blood, and those descended from a Negro to the third generation inclusive, though one ancestor of each generation may have been a white person.

    Even though the Code Napoleon was the basis for the Digest of 1808, the source of the law codified was the Spanish law established by the Proclamation of Governor O'Reilly in 1769
    By an act adopted in May 1806, the Legislative Council declared that only the writ of Habeas Corpus, and Trial by Jury would be the only two common law principles in effect in Louisiana
    n 1682, Rene' -Robert Cavelier, sieur de La Salle discovered the mouth of the Mississippi River and claimed the river and all the land drained by it for the King of France. On his return to France, the King sent La Salle back to Louisiana to start a colony. The colony founded by La Salle failed.
    The next colony in the Louisiana territory was founded at Biloxi, Mississippi by Pierre Le Moyne, sieur d'Iberville and Jean Baptiste, sieur de Bienville. However, the Louisiana colony was not making a lot of money for the King. In fact, the colony was costing France money at the time when the people in France were heavily taxed and the country was in a depression and burdened with debts. The Louisiana colony was turned over to Antoine Crozat, a wealthy merchant.
    The Louisiana colony became a trading company just like the English colonies that made up the original thirteen colonies of the United States. A royal charter was granted by the King of France to Crozat on September 14, 1712. The royal charter contained a provision saying that the Custom of Paris would govern Louisiana. The Custom of Paris was made up of edicts, ordinances and customs and usages in effect in the city of Paris.
