Statement from the Iowa Civil Liberties Union regarding bill mandating recitation of the Pledge of Allegiance by all students in Iowa.

On February 12, 2003, a bill (House File 172) was introduced in the Iowa legislature mandating that all students in all schools in the state of Iowa recite the Pledge of Allegiance at the beginning of each school day. [Text of bill follows at end.] The following is a statement released by Ben Stone, Executive Director of the Iowa Civil Liberties Union: "Considering the significant opposition that exists among Iowans to the war in Iraq, the timing of this bill is unfortunate. Even if well-intentioned, it is inescapable that this bill, if enacted, would have the effect of compelling conformity among people who disagree profoundly regarding the war. Our children, in particular, deserve to be insulated from such coercion, and our teachers should not be placed in the position of enforcing government mandates regarding the expression of ideas. "If this nation invades Iraq, Iowa's children should not become fodder in the conflict over the morality of that invasion. They should be allowed to learn and think about the profound implications of war without the government mandating the outcome of the debate.

New Sex Offender Civil Commitment Laws Follow Court Ruling
Legislatures in Florida, Iowa, Missouri and South Carolina passed laws in 1998 providing for involuntary civil commitment of violent sex offenders following their criminal sentence. The U.S. Supreme Court paved the way for states in the 1997 Kansas vs. Hendricks ruling that upheld that state’s Sexually Violent Predator Act. Thirteen states now have such "sexual predator" laws, including Arizona, California, Illinois, Kansas, Minnesota, North Dakota, New Jersey, Washington and Wisconsin. The new Florida law passed as House Bill 3327 commits sexually dangerous individuals to the Department of Children and Family Services and also requires that those committed pay for all or a fair portion of subsistence costs, if they have the ability to pay. The Iowa law (Senate Bill 2398) gives the State Department of Human Services responsibility for control and custody of committed sexual predators, including evaluation and treatment costs. It includes provisions for multi-agency teams and the review of cases by prosecutors, as does

New India Studies Book Published by IU Press Though a directive principle of the constitution, a uniform civil code of law has never been written or instituted in India. As a result, in matters of personal lawthe segment of law that concerns mar5riage, dowry, divorce, parentage, legitimacy, wills, and inheritanceindividuals of different religious backgrounds must appeal to their respective religious laws for guidance or rulings. But balancing the claims of religious communities with those of a modern secular state has caused some intractable problems for India as a nation.

Interest: Fighting Spam for the State of Iowa: Part 3
There are no easy solutions to fighting spam (or unsolicited commercial e-mail, UCE). However, the State of Iowa has a tool to help. Chapter 714E of the Iowa Code clearly defines what is acceptable and unacceptable UCE. The law provides remedies for recipients of messages that violate that code.
As part of our on-going series on spam and opt-in e-mail marketing, Alliance Technologies talked with Bill Brauch in Iowa's Attorney General's office. Mr. Brauch is a special assistant attorney general, and director of the office's consumer protection division. It is his office that helps fight fraud and misconduct through e-mail. While the outlook for fighting spam is uncertain, the Attorney General's office supported the enactment of Iowa Code chapter 714E in 1999. Alliance Technologies asked Mr. Brauch some key questions about the state's battle against spam.

View Environmental Audit Privilege and Immunity Act http://www.legis.state.ia.us/IACODE/2001/455K/1.html Iowa passed an Environmental Audit Privilege and Immunity Act in April 1998, codified at Title XI of the Code of Iowa, Chapter 455K, Sections 1 - 13. Iowa's law provides limited privilege for environmental audit reports resulting from a voluntary self-evaluation, and attempts to encourage voluntary disclosure to regulatory agencies of noncompliance by creating limited immunity against the imposition of state administrative, civil, or negligent penalties if voluntary disclosure occurs. An environmental audit report is privileged and is not admissible as evidence in any civil or administrative proceeding. The environmental audit report should be labeled, "ENVIRONMENTAL AUDIT REPORT: PRIVILEGED DOCUMENT."
