GENERAL CATEGORIES OF IMMIGRANTS
An immigrant visa is required of anyone who wishes to enter the United States to reside there permanently, whether or not that person plans to seek employment in the United States. U.S. immigration law provides for the issuance of immigrant visas in four general categories: Immediate relatives, family-based, employment-based and Diversity Immigrant Visa Program , known as the "Green Card Lottery."
Immediate Relatives
Immediate relatives of U.S. citizens are eligible to qualify for immigration in the immediate relative category.
Spouse or Minor Child of a U.S. citizen
An immigrant visa may only be processed for a child if he/she has no claim to U.S. citizenship Parent of a U.S. citizen U.S. citizen must be 21 or over Step-parent or child of a U.S. citizen Step-parent, step-child relationship must occur before the child’s 18th birthday Spouse of a deceased U.S. citizen Petition must be filed within 2 years of the death of the U.S. citizen
Family-Based Immigration
Persons seeking to immigrate in one of the family-based preference categories will qualify for immigrant status only if they have the necessary relationship to a U.S. citizen or Lawful Permanent Resident (LPR) as described below.

The Outrages of the Mexican Invasion More Articles By Tom DeWeese inside the United States in just the past few months. The Mexican government has issued more than 800,000 slick, pocket-sized identification cards to both legal and illegal immigrants. Those cards are being distributed through Mexican consulates all over the United States. Mexican ambulance drivers are transporting hospital patients unable to pay for medical care in Mexico to facilities in the United States. They know that the federal Emergency Medical Act mandates that U.S. hospitals with emergency-room services treat anyone who presents themselves for care, including illegal aliens. The ambulances are driving through unguarded portions of the border with "little resistance" at the instruction of Mexican officials. Schools are suffering the same fate as medical care as illegal aliens fill classrooms, bloat budgets, and rob taxpayers of decent facilities for American children. Federal law and an incredible Supreme Court ruling ban schools from denying free education to illegal aliens. Several cities have declared themselves "safe haven" for illegal aliens and refuse to enforce immigration laws. Los Angeles, Chicago, San Francisco, Seattle, New York City and even Falls Church, Virginia (in sight of the Pentagon), have all declared to be sanctuaries for illegal aliens. New York Mayor Michael Bloomberg announced that, "people who are undocumented do not have to worry about city government going to the federal government." In other words, these city governments refuse to uphold federal law or defend American borders.

The Mexican Matricula Consular Should Not Be Accepted for Official Purposes
The recent push by Mexican consulates in the United States for the acceptance of consulate-issued identification cards used by Mexican nationals living in the U.S. poses serious legal and national security issues. The Mexican government has successfully lobbied many state and local governments and businesses, and most recently a federal government building in California, to accept the IDs for establishing identity, opening bank accounts, various social service uses, check cashing, and airline travel. (The enormous population of illegal aliens, currently estimated by the Census Bureau to be about nine million, with perhaps four million of them from Mexico, is seen by banks as a potentially lucrative client base, for the handling charges on the money they are sending out of the country.)

Question 1. How does an individual obtain a temporary visa to enter the U.S.? TOP

One can enter the U.S. temporarily for a variety of other reasons: as a visitor or tourist, business person, student, or employees etc. These temporary visas are known as "non-immigrant" visas and are issued at U.S. embassies and consulates located in most countries. At the issuing embassy or consulate, the visa officer must be convinced that the visa applicant will not remain in the U.S. after expiration of the authorized stay. The burden is on the applicant to demonstrate through strong personal, professional, or other evidence that his/her intent is to depart the U.S. within the prescribed time frame. Visas may be valid for one or more entries into the U.S. and are accordingly referred to as single entry or multiple entry.
A visa, however, does not automatically guarantee entry to the U.S. The immigration Officer at the U.S. port of entry makes that final determination.

The officer noted that due to the nature of your wife’s case, it would be the best to get in contact with you regarding the return of your child who is an American citizen. The recommendation was given at your wife’s insistence that the return of the child was now the responsibility of the embassy. We apologize if there was some miscommunication regarding the matter. As for the refusal of your stepson and your wife, the interviewing officer was obligated under US immigration law to cancel the visa and refuse the Childs application. Your wife had overstayed her tourist visa for an extensive amount of time in the United States without authorization from the Immigration and Naturalization service. This is a serious offense that directly violates the laws governing the use of non-immigrant visas. Her sons visa was not issued because he could not meet the requirements of the Immigration Act that requires an applicant to prove he/she is coming back from the United States and will not overstay while there. We understand that the purpose of their trip was only for a short visit, but, unfortunately, because of your wife’s overstays, the law does not allow for the continued validity of her visa or the issuance of her sons. Your wife and her children may still apply for immigrant visas here at the embassy, though you are correct in noting that it does require frequent travel to the United States. If you choose to petition for your wife, the Immigration and Naturalization Service in the United States can decide whether or not your wife’s overstay can be waived.
