The course will consider the role of law in bioethics and how the law in bioethics is shaped by the interplay of ethical principles, medical considerations and social forces. Topics that will be covered include: the refusal of life-sustaining treatment, physician-assisted suicide, organ transplantation, abortion, the balance between individual liberty and protection of the public health, access to health care, and rationing of health care. Health Law and Policy Institute Until recently, tobacco control advocates were mostly concerned about preemption in the context of state laws that prevent local jurisdictions from enacting laws more stringent than state law mandates. The recent U.S. Supreme Court decision in Lorillard v. Reilly , 121 S. Ct. 2404 (2001) shifts the focus to federal preemption. In Lorillard , manufacturers and sellers of cigarettes, smokeless tobacco, and cigars challenged Massachusetts’s regulations that restricted the sale, promotion and labeling of tobacco products. Plaintiffs argued that the regulations were preempted by federal law, and that the regulations violated plaintiff’s First Amendment right of commercial free speech. The Court held that the Federal Cigarette Labeling and Advertising Act (FCLAA) preempted regulations governing outdoor and point-of-sale cigarette advertising. The Court also held that state regulations prohibiting outdoor advertising of smokeless tobacco or cigars within 1,000 feet of a school or playground violates the First Amendment to the U.S. Constitution. The Court struck down regulations prohibiting indoor point-of-sale advertising of smokeless tobacco and cigars lower that 5 feet from the floor of a retail establishment located within 1,000 feet of a school or playground, again citing commercial free speech concerns. The Court did uphold regulations requiring retailers to place tobacco products behind counters, however, rejecting the argument that requiring customers to have contact with a salesperson before handling tobacco products violates the First Amendment’s protection of commercial free speech. The Court held that Massachusetts demonstrated a “substantial, and even compelling” interest in preventing minor’s access to tobacco products, and that the state “adopted an appropriately narrow means of advancing that interest.” Therefore, regulations requiring retailers to place tobacco products behind counters withstood First Amendment scrutiny.

Recent Activities:
The department sponsored "Beyond Cloning: Protecting Humanity fromSpecies-Altering Procedures," a two-day conference to discuss policies to prevent human cloning and the alteration of the human species through genetic engineering. The conference began drafting treaty language to prohibit human cloning and inheritable alterations. To further this work, Global Lawyers and Physicians (GLP) participated in an NGO briefing to the United Nations on an international cloning treaty. Prof. George Annas, MPH student Rosario Isasi, and Visiting Scholar Miki Wada were among the presenters.
GLP co-sponsored the 4th annual conference on Health and Human Rights, "HIV/AIDS in Africa: Taking Action," which resulted in the Philadelphia Declaration for action to address the HIV/AIDS pandemic (posted at www.glphr.org).
MPH students Suganthi Narayanasami and Sana Younis led the human rights and health advocacy campaign for GLP, coordinating advocacy with both Boston-based and international NGOs.

How Far Are Limitations on Civil Liberties Justified?
The events of 9/11, the ensuing anthrax attacks, and the present threat of war with Iraq have dramatically increased concerns about bioterrorism. What is the level of the government’s preparedness? Do proposed government plans to ensure the public health of U.S. citizens threaten our civil liberties? Just how sweeping should the states’ powers be during a health crisis?
On Thursday, January 30, Brooklyn Law School’s Center for Health Law and Policy hosted a forum in which Professor Lawrence Gostin and Mark Barnes, Esq
The theory-practice seminar was moderated by Professor Nan D. Hunter , co-director of the Law School’s Center for Health Law and Policy.
The Center for Health Law and Policy, was established in 2002, building on the Law School’s strong presence in health law. The Center’s overall goal is to be a resource for members of the law school community, health service providers and policymakers by providing programs in three core areas – scholarship and faculty development, legal education and student services, and public education and community service. The theory-practice seminars bring scholars who are experts in a particular field of health law or policy together with practitioners whose work involves the same topic. View video from the event.

Interests : Health care law raises some of the most important and controversial issues of our time. These literally involve questions of life and death for many individuals, and they have profound implications for the economic well-being of society. The cost of providing health care now consumes one dollar in every seven we spend in the United States and is still growing. In other countries, similar trends are evident. Yet curbing such costs raises issues of political feasibility, distributive justice, professional autonomy, moral rights, and market efficiency. The Health Law Program at Harvard Law School draws together faculty working on such issues and organizes an integrated curriculum for interested students. It aims to provide law students with a thorough legal background in an area of practice that is growing commensurately with the industry's share of the economy. More important, it aims to do so in a contextual interdisciplinary manner so students can see the interactions between the different areas that make up health care law and better understand their policy implications. Basic Courses : Dr. Stone's course in Law and Medicine (not offered 2003-04) provides an introduction and overview to a broad array of basic issues germane to the contemporary American health care system, including, but not limited to, crisis and reform in health care, informed consent, right to die, right to treatment, and an introduction to issues in medical malpractice. This course addresses these issues in the context of the doctor-patient relationship and examines the interface of moral, ethical and legal problems in modern medicine.
