The Putative Father
A Putative Father is the alleged father of a child, either identified by the birthmother or unknown, who has not legally established his paternity of the child. A Putative father is not a legal father. A Putative Father must take legal steps to establish his paternity in order have any right to receive further notice of an Adoption proceeding or to have standing to contest an adoption. In Illinois, a Putative Father must register with the Birth Father Registry in order to receive notice of a pending adoption wherein he has been named as a Putative Father. A biological father, or alleged biological father becomes a party whose consent to adoption is required if he has been informed that he is the father of the child, and:
  • marries the mother, lives with the mother and supports the child, establishes himself as the legal father by filling a parentage proceeding, or

    So now you need a lawyer to help you protect yourself in a family law situation... Where do you turn? Finding the right lawyer to assist you is often the most important decision you will make if you are facing a paternity dispute, divorce or custody battle. So here are a few pointers to assist you in your quest to find the right lawyer for your situation. Do not immediately hire the first lawyer you speak to, even if they are referred by a trusted friend or acquaintance. Not all family law attorneys are equipped to handle all types of situations. Just because you were given a referral does not mean that lawyer is right for you. Interview several attorneys, including those you can't afford as many will give you a free or low cost consultation. Take notes and write down ideas and suggestions they share with you. If you don't have someone that can recommend a lawyer to you, check with local psychologists. Often courts call upon psychologists to do custody evaluations, and they should be able to steer you to a lawyer they have worked with who is effective. Also, you can ask local private investigators and process servers for their recommendations.

    Fathers for Equal Rights, Inc. (FER) is a Chapter 501(c)3, non-profit organization with an elected Board of Directors, serving the cause of fathers' rights since 1973. We are a strong advocate for equal parenting responsibility and strengthening the father-child relationship.     By Mark Charalambous, February 17, 2001 As the father's rights movement gains momentum and some much-needed recognition, it's instructive to periodically articulate the fundamental problem: Gender-profiling in family law, which virtually ensures that children lose any chance of a meaningful post-divorce relationship with their fathers. Opponents of fathers rights continue to disguise their antipathy to it by hiding behind the "best interests of the child" mantra. The courts are not biased against fathers, they say, they merely follow the law, which mandates that custody decisions be made in the "best interest of the child." Moms usually get custody, they argue, because they are the primary caretaker or "nurturing parent" in the family. Ignoring for the moment that even when fathers are the primary caretakers they still somehow end up as non-custodial parents, this primary caretaker policy is a holdover from the "tender years doctrine," which is no longer coded in Massachusetts family law. Because of the trend towards making the law gender neutral, it has become necessary to replace gender-specific language with politically correct code words, like "best interests of the child," "nurturing parent," and "abusive parent"
