The Brits Magistrate's Court ruled yesterday that seven of the 30 juvenile elephants which were allegedly ill-treated on a plot outside Brits could be exported to overseas zoos. Magistrate Herman Glas partially revoked an order he made last week giving custody of the animals to the National Council of the Society for the Prevention of Cruelty to Animals. "The order I made last week is revoked in regard to these seven elephants," he said. Glas made the ruling after an agreement was reached between lawyers for the NSPCA and for the elephants' owner, African Game Services boss Riccardo Ghiazza. The two parties agreed that the export would take place no later than December 16 and that two NSPCA officials would be allowed to examine the animals before they are moved. Other conditions include that African Game Services must obtain medical certificates for the elephants from the state veterinarian and the NCSPCA officials will be allowed to monitor their relocation. The recipient zoos must be told by the company that the elephants may have future behavioral problems because of the alleged abuse, and must acknowledge in writing that they were aware of the court proceedings. Erfurt Zoo and Dresden Zoo, both in Germany, are to get two elephants each, and the other three are headed for a zoo in Basel, Switzerland.

12 April 1999 Animals in Zoos now officially under Europe's Protection Eurogroup welcomes the Council adoption of a Directive on the keeping of wild animals in zoos. At the same time, the animal welfare group is concerned that the law is too focused on conservation and does not go far enough to prevent the suffering of animals kept captive in unsuitable conditions. This Directive requires zoos to be licensed and inspected but it is disappointing that no standard for the care and housing of animals are included. The campaign to improve the welfare of zoo animals through European legislation started a decade ago. This followed increasing complaints from citizens about deplorable conditions in many zoos and the first ever study of European zoos organised by Eurogroup and financed by the Commission. This study showed that 2/3rds of European zoos were below an acceptable standard of animal welfare. A further investigation in 1997 in 15 zoos in the EU showed that wild animals are still housed in cramped and inadequate conditions. The long-awaited Directive is a compromise, as the Commission and Council had to allow for those Member States who argue that the welfare of animals in zoos should be dealt with on a national level. Animal welfare campaigners managed to convince the EU to change the Commission's Recommendation into a legally binding law.

A study for the charity says in captivity the animals have about half the 30-year lifespan of their counterparts in Asian timber camps. Zoo breeding programmes are also said to have an "abysmal" record. In addition, 35% of zoo females fail to breed, 15-25% of Asian zoo babies are stillborn, and 6-18% are rejected or killed by their mothers. Current enclosures can be extremely small - up to 100 times smaller than the smallest wild territories - with 90% of those in Europe providing no grazing. The RSPCA study - A Review of the Welfare of Zoo Elephants in Europe - found many elephants in zoos also suffer from rough treatment at the hands of their keepers. Dr Rob Atkinson, head of wildlife, said: "In the vast majority of our zoos, elephant handlers try and dominate elephants by psychological means, physical restriction and punishment - a system known as traditional free contact. "While elephants are still kept in zoos, the RSPCA wants their management to be based on reward, not punishment, and for keepers to be protected from death and injury.
