This law allowed listing of only native animal species as endangered and provided limited means for the protection of species so listed. Related Resources The Departments of Interior, Agriculture, and Defense were to seek to protect listed species, and insofar as consistent with their primary purposes, preserve the habitats of such species. Land acquisition for protection of endangered species was also authorized. The Endangered Species Conservation Act of 1969 was passed to provide additional protection to species in danger of "worldwide extinction". Import of such species was prohibited, as was their subsequent sale within the U.S. This Act called for an international ministerial meeting to adopt a convention on the conservation of endangered species. A 1973 conference in Washington led to the signing of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), which restricted international commerce in plant and animal species believed to be actually or potentially harmed by trade.

KEEPING CAPTIVE/EXOTIC WILDLIFE Introduction People who want to acquire various wildlife species frequently contact MassWildlife for information . Some people already have an animal and may be disappointed or frustrated to learn they cannot lawfully keep it in Massachusetts. To avoid such problems and concerns, the public is encouraged to learn the laws pertaining to the possession of wildlife in Massachusetts before they acquire an animal. A summary of these laws is below. This is only a summary and people should refer to the appropriate Massachusetts General Laws (MGL) and the Code of Massachusetts Regulations (CMR) for details. Background: Massachusetts pet stores are inspected and regulated by the Department of Food and Agriculture but the stores must follow MassWildlife laws regarding the animals that they may sell. Purchasers can reasonably assume that an animal for sale in a Massachusetts pet store may be lawfully sold and possessed. Do not assume that animals for sale in other states, including those states adjoining Massachusetts, are lawful in Massachusetts. Similarly, be wary of animals advertised for sale on the Internet or in newspapers. These animals may be lawful at the point of origin, but not in Massachusetts.

STATE WILDLIFE POLICY PROTECTED SPECIES OF WILDLIFE The game animals and quadrupeds, game birds and fowl, and game fish as herein defined shall be protected, and hunting, taking, capturing, killing or possession, or attempt to do so, a species named herein shall be regulated by the Commission (17-2-2). Fur-bearing and nongame animals are state property until lawfully taken, killed or trapped during seasons declared by Commission regulation (17-5-2 and -3). In making regulations regarding when and by what means fur- bearing animals may be hunted, taken, captured, possessed or killed, the Commission shall give due regard to zones of temperatures and to the distribution, abundance, economic value and breeding habits of such animals (17-5-4). HABITAT PROTECTION No person owning or controlling a lake or body of water into which public waters flow and which supplies water to a stream containing game fish shall divert or lessen such water flow to an extent detrimental to fish (17-4-14). Persons floating logs, timber, or lumber in a stream containing game fish, for each mile of the streams used, shall deposit annually one thousand trout fry or fingerlings at the times and places designated by the Department. RARE AND ENDANGERED PLANTS . In the late 1960s and early 1970s, concern over the state's dwindling natural resources led to the establishment of such organizations as the Rare Plant Study Center and the Texas Organization for Endangered Species to document the rare plants of Texas. Natural area surveys, conducted by a multidisciplinary team of scientists, began in 1973 with the support of the Lyndon Baines Johnson School of Public Affairs and the Texas Parks and Wildlife Department. qv In 1978 Texas wild rice qv Zizania texana ) became the first Texas plant to be federally listed as endangered.
