The criminal justice system in the United States of America is a hybrid system, involving state and federal government agencies. The power to make criminal laws is divided between the federal and state governments. For examples, most crimes are punished under state laws but there are some federal laws which create and punish certain conduct as well. The Constitution of the USA gives the federal government jurisdiction over tax, interstate commerce and mail and on that basis, the federal government has enacted laws which create crimes such as failing to file an income tax return, transport a stolen car across state lines and defrauding the postal service. State criminal laws are usually consolidated in state penal, vehicle or health codes. For a sample state penal code, readers are invited to consult the Texas Penal Code . Also, procedural matters vary from state to state.

Criminal and Immigration Law Update September 18 , 2001 SUPREME COURT DECISIONS AFFECT IMMIGRANTS During the last term, the United States Supreme Court decided five cases with significant impact on the field of immigration law and crimes. Two of these decisions were very favorable to the noncitizens. Habeas Corpus Jurisdiction and Eligibility for § 212(c) Relief Practice Advisories and information regarding the proposed INS regulations on the implementation of the St. Cyr decision are available on these topics from the American Immigration Lawyers' Association, the National Immigration Project of the National Lawyer's Guild, and the American Civil Liberties Union Immigrants' Rights Project. Further Support for Defense Counsel's Obligation to Advise of the Immigration Consequences of a Plea. The Supreme Court also acknowledged in the St. Cyr decision that criminal defense counsel routinely advise their clients concerning immigration law, and pointed out that 19 states and the ABA require them to inform the defendant of the potential immigration consequences of a plea. The Court found a significant reliance interest among criminal defendants who had entered guilty pleas prior to 1996 when INA § 212(c) relief was still available:

District Building Washington, D.C. 20004 Dear Chairman Nathanson: Thank you for this opportunity to express the support of the Executive Branch for Bill 10-30, the "D.C. Criminal Code Right to Privacy Amendment Act or 1993." This bill would amend the District statute which makes sodomy a felony, by providing that it would not apply to acts engaged in only by consenting persons who are 16 or older. Moreover, since even before the advent of Home Rule, it consistently has been the official position of the District government not to make arrests for acts of sodomy committed by consenting adults in private. Then Police Chief Jerry Wilson clearly enunciated that policy in 1973, and it has been continually reiterated, most recently last year by the current City Administrator. Furthermore, it should be noted that Congress recently enacted the Sexual Abuse Act of 1986 to define what sexual acts are prohibited in federal prisons and other places where the Federal Government exercises exclusive jurisdiction. See 18 U.S.C § 2241

Grand Juries in the News Common law grand juries had a foreman, who administered the oath to witnesses testifying before the grand jury, saw that it received other kinds of evidence and generally ran the grand jury's sessions. Federal grand juries have a "foreperson" and a "deputy foreperson." The deputy takes over when the foreperson cannot attend a grand jury session.
Forty-nine states and the District of Columbia also retain the office of grand jury foreman ("foreperson), but three statesIdaho, Kansas and Wyominguse the term "presiding juror" rather than foreperson. Connecticut does not need the office grand jury foreperson because it eliminated grand juries composed of citizens and replaced the civilian grand jury with a grand jury that is composed of one judges, who presumably do not need a foreperson to run their affairs.
Of the 50 jurisdictions that have a foreperson/presiding juror, 24 give this officer a deputy. Five states add another officer: In Florida, North Dakota, Oregon and South Dakota, this person is known as the grand jury's clerk; in Nevada he/she is the grand jury's secretary. Federal law does not recognize either position, but grand juries in some federal do choose a secretary, out of local custom.

WASHINGTONThe U.S. Supreme Court ruled on Wednesday that states may place names and photographs of convicted sex offenders on the Internet. In a 9-0 decision , the justices overturned an appeals court's earlier ruling that said Connecticut's version of "Megan's Law" violated the due process rights of people forced to register under it. The law is named after Megan Kanka, a New Jersey girl who was killed by a sex offender. Chief Justice William Rehnquist, who wrote Wednesday's opinion, stressed that a Connecticut Web site did not claim that the sex offenders featured on it currently posed a threat to the community. That site displayed only "the fact of previous conviction, not the fact of current dangerousness," Rehnquist wrote. "Indeed, the public registry explicitly states that officials have not determined that any registrant is currently dangerous."

Connecticut treats this offense with extreme seriousness because of the risks involved with the operation of a motor vehicle while intoxicated. When an individual is arrested for DWI in Connecticut he or she must resolve the case in two separate forums.     • : As most people are aware, operating a motor vehicle while under the influence of alcohol is a criminal offense. Although most people think that the police must test the person's blood alcohol content in order to obtain a conviction, that is not the case. Operating "under the influence" may be prosecuted with or without any direct evidence of a person's blood alcohol content. The determinative issue is whether a person's ability to drive has been affected to an appreciable degree. This fact be proven through direct testimony of the police officers and/or other witnesses, without testing a person's blood alcohol content. However, in most cases, a breathalizer test is performed to test blood alcohol content, primarily because the refusal to take such a test requires an automatic 180 day suspension from the Motor Vehicle Department.

The United States continues to be among those countries worldwide which suffer the highest degree of destruction to life and property from fire. The arson/fraud fire problem continues to contribute to these statistics at an alarming rate.
Concern over this unnecessary loss of life and property has triggered a rapidly growing need for professionals in fire science. The municipal fire service is only one part of this demand for individuals with specialized education in this multidisciplined field. Career opportunities in the public sector include municipal firefighters, fire inspectors, fire investigators, fire technicians and fire protection engineers. Private sector careers include industrial firefighters, fire protection specialists, fire protection engineers, fire investigators and loss control consultants. Government, industry, fire equipment manufacturers and vendors, and the insurance industry are all potential employers.
The University of New Haven offers three undergraduate degrees and four certificate programs designed for those individuals entering the exciting field of fire science. A combination of classroom lectures, laboratory sessions, case studies and field trips are utilized to give the student the broadest possible exposure in this area of study. SURREPTITIOUS RECORDING OF TELEPHONE CONVERSATIONS We are often asked whether one party to a telephone conversation may tape record the conversation without the consent of the other party. A related question involves surreptitious recordings of employees or others by their employers or others using an extension telephone or similar device on the same premises. This area is subject to a patchwork of both federal and state regulation. Accordingly, it is necessary to look at both federal and state law; whichever law is more restrictive will generally be applicable. Federal law may preempt state law in certain instances. As noted below, an attorney should be consulted because of the complex interplay of different regulatory schemes. Federal Law The federal Omnibus Crime Control and Safe Streets Act of 1968, 18 U.S.C. § 2510 et seq., prohibits the willful interception of telephone communication by means of any electronic, mechanical, or other device without an applicable exemption. There are two principal exceptions: Federal Exceptions Consent In the absence of more restrictive state law, it is permissible to intercept and record a telephone conversation if one or both of the parties to the call consents (as long as the tape is not made for a tortious, criminal or otherwise illegal purpose such as blackmail). Consent means authorization by only one participant in the call; single-party consent is provided for by specific statutory exemption under federal law. 18 U.S.C. § 2511(2)(d).
