Continuing Education REQUIREMENT MFT's and LCSW's whose licenses expire January 31, 1999 or later, must complete CE within the preceding two years of the license renewal date. COURSEWORK MFT's and LCSW's are required to take classes relevant to their scopes of practice. Training, education, and coursework by approved providers shall incorporate one or more of the following:
  • aspects of counseling or social work that are fundamental to the discipline aspects of counseling or social work in which significant recent developments have occurred aspects of other disciplines that enhance the understanding or practice of counseling or social work
  • Additional licensee information is available in CE FAQ's for MFT's and LCSW's MANDATORY COURSES Spousal or Partner Abuse- Effective January 1, 2004 all licensees will be required to complete a one-time course in spousal or partner abuse assessment, detection, and intervention strategies including community resources, cultural factors, and same gender abuse dynamics. There is no hour length specified for this requirement. The Board may accept evidence of completion of an equivalent course or courses taken prior to January 1, 2004 or may accept prior teaching or practice experience in order to fulfill the continuing education requirement.

    education law: an overview
    One government function is education, which is administered through the public school system by the department of education. The states, therefore, have primary responsibility for the maintenance and operation of public schools. The Federal Government also has an interest in education. The National Institute of Education was created to improve education in the United States. Each state is required by its state constitution to provide a school system whereby children may receive an education. State legislatures exercise power over schools in any manner consistent with the state's constitution. Many state legislatures delegate power over the school system to a state board of education. There is a strong concern with equality in education. Within states this leads to efforts to assure that each child no matter where he or she is situated receives an adequate education. The Equal Education Opportunities Act of 1974 provides that no state shall deny equal educational opportunity to an individual on the basis of race, color, sex, or national origin.

Privacy of and Access to University Public Records The California Public Records Act declares that access to information concerning the conduct of the people's business is a fundamental and necessary right of every person in the State, that public records are open to inspection at all times during regular office hours, and are subject to inspection and copying by every person except as provided in the Act.     Continuing Medical Education Continuing Medical Education (CME) is a mandatory requirement established by California law to create the most competent licensing population possible, thereby enhancing consumer protection. Initial regulations were adopted in December 1976. These regulations have been subsequently amended. This information reflects the most recent revisions as of 1996. All CME courses must be Category 1 approved. Category 1 means courses that directly relate to one of the following: patient care, community or public health, preventive medicine, quality assurance or improvement, risk management, health facility standards, the legal aspects of clinical medicine, bioethics, professional ethics, or improvement of the physician-patient relationship. Courses approved by the Division of Licensing for Category 1 CME include programs which are approved by the California Medical Association and the American Medical Association and programs which qualify for prescribed credit from the American Academy of Family Physicians.

    English Language Education for Immigrant Children Proposition 227 Update: At its April 8, 1999 meeting, the State Board of Education voted 7 to 2 to eliminate requirements that were previously in force and unchanged by Proposition 227 regarding identification, reclassification and assessment of LEP students. According to Multicultural Education,Training, and Advocacy, Inc. (1999, Spring) the SBOE changed 1) 5 CCR 4303 that required assessment of students in their primary language for initial identification; 2) eliminated the requirment for objective standards and procedures for reclassifying LEP students as fluent English proficient (5 CCR 4306) and 3) eliminated the requirement to conduct an annual assessment of the academic progress of LEP students (5 CCR 4311). The SBOE stated reasons were that the language of the regulations was inconsistent with the provisions of Proposition 227 and that it felt the need to give school districts more flexibility. META has filed a legal memorandum opposing the changes on the grounds that they seriously undermine rights neither curtailed by passage of 227 nor inconsistent with its provisions and that the changes consistute an action in excess of the authority granted to the board by the Legislature. Among the policies and procedures left in place under established regulations are the requirements for teacher qualifications and authorizing credentials for serving English language learners (BCLAD and CLAD credential or certificate).

(PAI) RE: Recording Occupational and Physical Therapy in IEPs Many special education students require occupational therapy (OT) and physical therapy (PT) services in order to benefit from special education. OT and PT are "related services" under P.L. 94-142, the Education for All Handicapped Children Act. [20 United States Code (U.S.C.) Section 1401(17); 34 Code of Federal regulations (C.F.R.) Section 300.16(b).] Under California law, OT and PT are referred to as "designated instruction and services" or "DIS." [California Education Code Section 56363(b)(6).] The amount of OT/PT services to be provided must be determined by the child's IEP team according to how much he or she needs to benefit from special education and not according to CCS "standards." Of course, medical prescriptions and expert opinions are relevant to this decision, but each of these must relate to what the child needs in order to benefit from his or her educational program A statement of the specific related services to be provided to a child must be included in his or her IEP.     Clery Act Overview
    The "Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act of 1998," commonly referred to as the "Clery Act," requires institutions of higher education receiving federal financial aid to report specified crime statistics on college campuses and to provide other safety and crime information to members of the campus community. The University provides crime information and statistics to the public in a variety of ways. In addition to the Clery Act, the University provides to the California Department of Justice crime statistics that are classified pursuant to the Uniform Crime Reporting (UCR) Program administered by the FBI. These statistics are reflected in the University of California Police Department Annual Report and Crime Statistics , the annual California Department of Justice Crime in California , and the annual FBI Crime in the United States publications.
