The California State Board of Education (SBE) is the governing and policy-determining body of the California Department of Education ( CDE ). The State Superintendent of Public Instruction, who heads the CDE, also serves as the SBE's executive officer and secretary. The SBE sets K-12 education policy in the areas of standards, curriculum, instructional materials and assessment. The SBE also adopts textbooks for use in grades K-8, and it adopts regulations to implement legislation. In addition, the SBE has the authority to grant local education agency requests for waivers of the state Education Code. The SBE has 11 members, all of whom are appointed by the Governor and serve four-year terms, with the exception of the student member, who serves a one-year term. SBE at Work

PUBLIC COLLEGES California Education Code 66301 . (a) Neither the Regents of the University of California, the Trustees of the California State University, nor the governing board of any community college district shall make or enforce any rule subjecting any student to disciplinary sanction solely on the basis of conduct that is speech or other communication that, when engaged in outside a campus of those institutions, is protected from governmental restriction by the First Amendment to the United States Constitution or Section 2 of Article 1 of the California Constitution.
(b) Any student enrolled in an institution, as specified in
subdivision (a), that has made or enforced any rule in violation of subdivision (a) may commence a civil action to obtain appropriate injunctive and declaratory relief as determined by the court. Upon motion, a court may award attorney's fees to a prevailing plaintiff in a civil action pursuant to this section.

(a) For purposes of this Article:
(1) ''Continuing Education'' means the variety of forms of learning experiences, including, but not limited to, lectures, conferences, academic studies, in service education, institutes, seminars, workshops, extension studies, and independent/home study programs undertaken by registered nurses for relicensure. These learning experiences are meant to enhance the knowledge of the registered nurse in the practice of nursing in direct and indirect patient care. (2) ''Course'' means a systematic learning experience, at least one hour in length, which deals with and is designed for the acquisition of knowledge, skills, and information in direct and indirect patient care. EDUCATION Education Program A major function of the Board is protection of the consumer through education. The goal is the educational preparation of safe and competent practitioners. It is the Board's philosophy that visionary and innovative leadership in the development of educational standards will prepare licensees for safe practice. The Board's Education Program is responsible for:
  • the accreditation of vocational nursing and psychiatric technician schools, including approval of faculty and facilities utilized by the VN and PT programs;
    "Pursuant to regulations that became effective July 1, 2000, the Board has authority to place vocational nursing and psychiatric technician programs on provisional accreditation. Provisional accreditation means that a program has not met all requirements as set forth in Article 5 of the Vocational Nursing or Psychiatric Technician Rules and Regulations. Provisional accreditation status is implemented in accordance with sections 2526.1 and 2530(l) of the Vocational Nursing Rules and Regulations and sections 2581.1 and 2582(l) of the Psychiatric Technician Rules and Regulations."
    Provisional accreditation is temporary. While on provisional accreditation, a program must work toward full regulatory compliance. Once full compliance is achieved, full accreditation status may be reinstated by the Board. If full compliance is not achieved, the Board may remove the program from its list of accredited programs.

Rulemaking Rulemaking Current Proposed Ammendments Proposed Addition of Title 5 Sections 80473 and 80473.1, Pertaining to Allowance of a Grace Period for Credential Candidates to Complete Requirements Rationale for Proposed Regulations:
On October 5, 2001 Governor Davis signed AB 1307 (Goldberg) (Statutes of 2001, Chapter 565), adding section 44252.1 to the Education Code. This bill, which became effective January 1, 2002, allows a grace period for candidates currently enrolled in a credential preparation program to complete requirements that were in place when they entered the program. The addition of Education Code Section 44252.1 aligns with current Commission practice to allow credential candidates sufficient time to complete programs in which they originally enrolled. AB 1307 requires the Commission to adopt regulations to implement this bill. The Commission released Coded Correspondence 02-0005 on April 29, 2002, which outlined the Commission's initial implementation of the statute.
