This review relates to the 4th Edition, which has been fairly significantly updated since the last reviewer's post.No doubt about it, this was written to be a textbook, it's fairly dense and packed with information. Yet it's also a pretty interesting read if your course takes the time to go through it. I also recommend the Mental Health and Disability Nutshell (Hermann) as a supplement - however that has not been updated since '97 and while most of the information is accurate, the text does contain topics the nutshell doesn't discuss.

Good coveage of the caselaw when it was published in 1998, but much has happened in the mental health area of law since then.The clinical studies and theories were hopelessly outdated when the text was published, and are today so dated as to do a disservice to the reader.Until this text is updated, especially in the clincal areas, I cannot recommend it.

While being a very scholarly yet easy to read book, the authors take an interesting position between law and psychology.They seem to implicitly favor "technique" in forensic evaluations complete with methods used by lawyers to tear psychologists down.And while there may be psychologists who do not adhere to the best practices, which needs to be pointed out, the authors completely ignore the sleazy tactics used by attorneys who use whatever they can find to discredit a witness, and/or confuse the testimony, all for the sake of winning.The authors unwittingly or unknowingly fail to address this issue.The tactics are emphasized without sufficient reference to factual accuracy.An example of this would be attorneys who use the authors referenced tactics to confuse testimony by psychologists and keep jurors confused, thus weakening the opponents case.What would have been preferred was methods to help reduce and or eliminate such attempts by attorneys along with some real psychological tactics for psychologist to use to make evident to jurors, that the lawyer is attempting to confuse the facts and move away from a genuine (and truthful) understanding of the matter at hand.
In that attorneys are generally regarded as one of the least admired professions in various surveys and psychologists are more highly rated, let's not do anything as psychologists to narrow that gap.

The primary author is well known as an instructor of "Family Law" for graduate students of psychology, social work, marriage & family therapy, etc. at several north Texas universities.His courses arealways well-received.A previous reviewer commented that a mental healthprofessional would have been helpful.I doubt that would make a differencesince so many professionals from various clinical disciplines use theseauthors as resources.This book is a great adjunct to remind yourself whatyou need to do as a professional to protect yourself & your clients. I stumbled across this book while preparing a project as part of my undergrad Psychology studies at the University of Utah. What a lucky find this is! *** Many statements exist in the world of mental health practice regarding what standards of professionalism, ethicality, conduct, andconfidentiality a psychologist should adhere to. Many of them, I'vediscovered so far, are abstract: they state the standard but give little,if any, illustration on how a practicing therapist applies all that tohis/her job and life. This book is the first I've uncovered that gives theclear and understandable picture that I need as an aspiring psychologist.*** I think I understand well enough the general principle that motivatedthe authors to write this book: all too often, each of us has gotten burnedin the past because of some rule, some technicality, some law that wouldhave worked in our favor had we acted with a knowledge of it. For example,I know someone who wouldn't have paid a single cent of his medical billscaused by an on-the-job accident had he simply reported his injury within48 hours instead of waiting a week. Things like that. I'm always makingsure I do things like keep receipts, review credit card statements, andwatch what creeps into my college transcripts, because it's the littlethings that can screw our lives up so badly. All the more so fortherapists, the authors believe, because of their heavy responsibility tosafeguard their clients' welfare, and because unfortunately their trainingdoesn't seem to prepare them for some types of potential legal trouble. ***As part of that approach, this book takes an interesting departure fromother literature on mental health ethics. Despite what the title says, thecontents seem to focus not so much on protecting the client--although thatprinciple is by no means diminished--as it does on protecting thetherapist. That may seem selfish, but hey, you've got to learn this stuffsomehow! *** The authors do an excellent job of explaining a diversity ofissues in understandable ways. They use well-constructed scenarios thatmake you ask yourself, "what would I do if faced with thisdilemma?" Then they systematically explain what the options are, andwhat to avoid along the way. They show you several sample documents alongthe way that demonstrate how to remove any legal doubts from your practice.The objective is to prevent things from going wrong, but they also discusswhen things get ugly, such as a client who commits suicide and therelatives sue you, the therapist, for malpractice. Or when to breachconfidentiality and activate your "duty to warn" if a clientthreatens violence against someone else--or yourself. *** I noted that theauthors were both lawyers, and that only one was licensed as a mastersocial worker. I wish, despite their impressive knowledge and experience,that a psychologist might have collaborated with them on this work. The system created by the General Agreement on Tariffs and Trade and later by the World Trade Organization (WTO) has proved to be an efficient instrument for the elimination of trade and tariff barriers. This process coincided with increased national regulatory controls, which were particularly visible in the area of risk regulation. Governments, responding to the demands of their domestic constituencies, have adopted a wide range of regulatory measures aimed at protecting the environment and human health. Although, for the most part, the new regulatory initiatives served legitimate objectives, it has also turned out that internal measures might become an attractive vehicle for protectionism, taking the place that was traditionally occupied by tariff barriers. Regulating Health and Environmental Risks under the WTO Law examines the WTO Agreement on the Application of Sanitary and Phytosanitary Measures (SPS Agreement). In which it is an attempt by the international community to limit possible abuses while assuring WTO Members of an extensive margin of regulatory discretion.

The central problem that the book tackles is whether the system established by the SPS Agreement can address the existing and potential challenges of a new interdependent world. In answering this question, the author provides a comprehensive and critical examination of the substantive provisions of the Agreement and corresponding case law. In this context, the book particularly focuses on two issues: the consistency in the interpretation of the SPS Agreement and the appropriateness of its various requirements.
